Terms and Conditions
For your stay at the Fernblick holiday home
This English version is a courtesy translation. Only the German version is legally binding.
We want you to feel completely at home at the Fernblick – and for everything to be clear before you arrive. So we’ve summarised here what applies to your stay. As short as possible, as fair as possible.
1. Who we are and what these terms cover
Your hosts are Murat and Nadja Bayram, Alfred-Maul-Str. 8, 64720 Michelstadt, Germany, phone +49 (0) 156 7933 2868, email [email protected].
We rent out the Fernblick holiday home, Hauptstraße 58a, 64720 Michelstadt-Würzberg. These terms apply to all bookings you make directly with us – via our website, by email, phone or WhatsApp. This is a rental contract for holiday accommodation, not a package holiday.
If you book via a platform such as Airbnb or Booking.com, the platform’s conditions apply to payment and cancellation. Our house rules (section 7) still apply to your stay in the house.
2. How your booking is made
Your enquiry is non-binding. We then send you an offer. If you accept it, we confirm the booking by email – this concludes the rental contract. If you book directly via our booking page, the contract is concluded with our booking confirmation.
The person booking must be at least 18 years old and travel with the group. You are our contracting party and make sure that your fellow travellers also comply with these terms.
3. Prices and what’s included
All prices are final prices in euros including 7 % VAT. You rent the whole house – the price is the same whether there are two or six of you. Additional guests cost nothing extra. The rental price includes:
- the whole house with all furnishings and equipment,
- electricity, water, heating and air conditioning,
- Wi-Fi throughout the house,
- bed linen and towels – the beds are made when you arrive,
- the parking space right at the house,
- charging your electric car at our wall charger (for normal use during your stay),
- your dog – we don’t charge anything extra.
A one-off final cleaning fee of €50 is added. There is no tourist tax or guest contribution in Michelstadt.
The minimum stay is 2 nights. A maximum of 6 people, including children, can stay overnight in the house.
4. Payment
We don’t ask for a deposit. About 5 weeks before your arrival we send you the invoice. It is payable within 7 days – i.e. no later than 4 weeks before arrival. You can pay by bank transfer (the invoice also has a QR code for your banking app) or conveniently online by card, Apple Pay, Google Pay or PayPal. Online payments are processed by our payment provider Stripe, at no extra cost to you.
If you book at shorter notice, the invoice is due within 7 days, but no later than the day before your arrival.
If payment is not received on time, we will remind you and give you a reasonable deadline. If you still do not pay, we may withdraw from the contract and charge cancellation costs as set out in section 5.
5. If you need to cancel
Please cancel by email to [email protected]. The day your email reaches us counts.
- Up to 4 weeks (28 days) before arrival you can cancel free of charge. If you have already paid, you get everything back.
- After that we charge 90 % of the rental price. We do not charge you the final cleaning. This also applies if you do not arrive.
If we can rent out the period to someone else, we will credit the income. You may also prove to us that we suffered no loss or a smaller loss. You are also welcome to name a replacement guest who takes over your booking on the same terms – we will only refuse this for good reason.
If you leave early, the full price remains payable. Here too, we credit what we earn by renting the house out again.
Would you like to change your dates? Talk to us. If the calendar allows, we’re happy to make it work.
There is no right of withdrawal for holiday accommodation (§ 312g (2) no. 9 German Civil Code, BGB). We therefore recommend travel cancellation insurance.
6. If we have to cancel
We only cancel if there is really no other way – for example because the house is uninhabitable after damage. In that case we will let you know immediately and you will get back everything you have paid. You have further claims under the statutory rules if we are responsible for the reason.
If your stay becomes impossible due to circumstances for which neither you nor we are responsible (for example official orders or natural events), you do not have to pay anything and will be refunded anything already paid.
If someone does not comply with the house rules despite a warning – for example a party, more guests than booked or a considerable disturbance of the peace – we may terminate the contract without notice. The rental price then remains payable, less what we save as a result.
7. House rules
- Non-smoking house: No smoking in the house, including e-cigarettes. If we have to clean or air the house thoroughly as a result, we will charge the actual costs.
- Timber house: Please no open flames in the house, including candles.
- Quiet hours: Please keep quiet from 10 pm to 7 am. We have neighbours and would like it to stay that way – thank you!
- No parties: Parties, events and stag or hen parties are not allowed. Visitors during the day are fine after a short arrangement with us; only booked guests may stay overnight.
- Dogs: Your dog is welcome – at no extra charge. Please just let us know when you book that your dog is coming.
- Children: Please keep an eye on your children, especially on the stairs and on the gallery.
- Technology: You operate lights, heating and air conditioning using the switches and remote controls in the house. Please do not change any other settings of the building technology.
- Wi-Fi: Please only use the Wi-Fi within the law. You are responsible for any legal violations committed via your access.
- Waste: Please separate your waste – thank you!
8. Arrival and departure
Check-in is from 3 pm. On the day of departure please leave the house by 10 am. You’ll find everything about getting here and the keys on your personal guest page before you arrive. Would you like to arrive earlier or leave later? Just ask us – if it fits, we’ll make it work.
Guests with a foreign nationality must fill in a registration form with us (§ 29 German Federal Registration Act, BMG). You can do this conveniently in advance via the online check-in on your guest page.
We take care of the final cleaning. Please still leave the house tidy: dishes washed or in the dishwasher, waste separated in the bins, fridge empty.
9. If something isn’t right
If something doesn’t work or is broken, please contact us immediately – by phone or WhatsApp – so we can take care of it quickly. If we only find out after your departure, there is nothing more we can do and your claims may lapse (§ 536c BGB).
10. Liability
You: Please treat the house and its furnishings with care. If something breaks, please let us know straight away. You are liable under the statutory rules for damage caused by you, your fellow travellers, your dog or your visitors. Normal wear and tear is of course our responsibility. We do not ask for a security deposit. We recommend private liability insurance that also covers damage to rented property and – if you’re travelling with a dog – dog liability insurance.
We: We are liable without limitation for intent and gross negligence as well as for injury to life, body and health. In cases of slight negligence we are only liable if we breach an essential contractual obligation, and then limited to the typical, foreseeable damage. Otherwise our liability for slight negligence is excluded. Liability under the Product Liability Act remains unaffected.
11. Privacy
You can read how we handle your data in our privacy policy.
12. Gift vouchers
You can buy gift vouchers on our website – by bank transfer or online. A voucher is valid for three years, until the end of the calendar year; the expiry date is shown on the voucher.
You can redeem it for any direct booking with us, also in part – any remaining balance stays valid until expiry. Vouchers are transferable. They cannot be exchanged for cash. Vouchers cannot be redeemed for bookings made via Airbnb or Booking.com.
13. Final provisions
German law applies. If you live in another EU country, the mandatory consumer protection provisions of your country remain unaffected.
We do not take part in dispute resolution proceedings before a consumer arbitration board and are not obliged to do so. If something goes wrong, just talk to us directly – we’ll find a solution.
If any provision of these terms is invalid, the rest remains valid. The statutory provision then applies instead.
